Risks

The American Tribunal is not without substantial risk.

There are many who support, with almost religious fervor, the Trump/MAGA regime and Donald Trump himself. These people may, and many probably will, have strong reactions to the Tribunal, especially after it begins its work.

These supporters have shown, such as on January 6, 2021, that they are willing to use mass violence.

Acceptance

This proposed American Tribunal is a new thing that does not fit easily into, or around, the Consitution of the United States.

Academics, especially lawyers, will tend to object even to the existance of the Tribunal as something that is unconstitutional.

This writer believes that the foundations of the Tribunal can be firmly founded on the resdidual distribution of national powers to the various states and to the people, as described in the nineth and tenth amendments as well as the Preamble, of our Constitution. However, this writer also recognizes that these legal and historical are new and untested.

Opposition To The Tribunal

Former officials of the United States government will have stong negative reactions against the Tribunal. These people will question its legitimacy, its procedures, its rulings, and will also demean (or worse) Tribunal staff.

Defendants As Martyrs

Mere accussation by the Tribunal will be seen by many as a sign of honor. Conviction will turn people who are monstors into living martyrs.

Risk Of Violent Reaction

The physical facilities, offices, and staff of this American Tribunal will, almost without doubt, be attacked both in the media and physically.

After years of violence against organizations such as Planned Parenthood and historical violence such as the Baptist Street Church Bombing on September 15, 1963 we ought not to be Pollyannaish and think that strong confrontations and violence will not occur.

Physical security for facilities, meetings, and people (including witnesses as well as staff) will be expensive.
