Justice After The End of MAGA

There is no doubt that the Trump/MAGA Era (TME) is one of vast corruption, widespread predation, and damage to people and institutions.

It is said that "All things shall pass." If that is true then we can hope that the Trump/MAGA Era will end - soon - and not linger.

When it does end there will be a prodigious mess.

So what are we going to do to recover, to remedy the harms, and to compensate people and institutions that have been victimized?

We must consider these goals:

• Punishment for crimes.
• Disgorgement of improperly obtained wealth, assets, and powers.
• Nationalization of "gifts" made in violation of the Constitution's emoluments clauses.
• Reversal of transactions based on bribery (using a definition more realistic than the naive version used by SCOTUS.)
• Compensation and restitution for people and institutions that have been harmed.
• Termination of excessive immunities for Federal officials (including the President).
• Determent of future corruption and predation.
• Elimination of our American Gestapo; ICE and CBP must be returned to their traditional, limited functions.
• Reconstitution and restoration of damaged institutions.
• Prevention of Federal use of private intermediaries to perform acts that are denied to the Federal government.

In many cases our legal system is neither structured nor prepared to do this. And our Constitution, at first glance, appears to constrain our power to do this (however, we will make a deeper inquiry into those perceived or presumed limits.)

So what are some of the problems we will face along the way? (We may feel like Diogenes futiliy searching for a wise or honest man.)

• The Constitution does not provide clear guidance. Because the three-branches of our Federal government have all become corrupted (or self-emasculated) it is impossible to rely on what are pleasant, but now largely meaningless school-room phrases such as "separation of powers" or "checks and balances." We are probably going to have to look deep at the Constitution to find remedial means within the traditional readings of the Constitution.

• Our Federal (and some State) institutions, and the people who run them, participate in the wrongs with which we must deal. Of particular concern are the US Supreme Court, the Federal Justice Department, and the US Treasury. (Congress, since the beginning of the Republic, has slowly given away its powers and thus may have but a diminished role to play in reconstituting our Nation.)

• We have grown accustomed to solving problems of this nature through the court system. But that system itself has become corrupted through the appointment of maga-biased judges throughout the Federal system and the clear transformation of SCOTUS from a court of even-handed justice into a reactionary body, detached from principals of law, logic, and precedent, with a string demonstrated bias in favor of those who are destroying our country.

  Our justice system has long elevated and institutionalized the belief that judges have limited jurisdiction, that judges must refrain from anything that even remotely smacks of "legislation from the bench". Such is right and proper. However, courts have allowed those goals to become barriers to justice - remedies are often a weak shadow of what they could be and the rule that those who come before the courts must have "standing" has closed the courthouse doors on many an important case, leaving ill doers effectively free from judicial review or oversight.

• Our Supreme Court has lost its way. Those full decisions it makes are often flights of fantasy into the kind of laissez-faire world of the 1880s. And its use of the Shadow Docket has turned SCOTUS into a rubber stamp for tailored, usually highly regressive cases without offering any sort of proper legal opinions that could provide future guidance.

• Trump/MAGA forces are working hard to assure that there will be no fair elections or election districts in the US in the future. In addition they are making changes to laws so that as few people as possible will be qualified to vote in local, State, or Federal elections.

• The present administration has shown itself ready and willing to overlook reality, overlook law, and overlook court judgments.

• The present administration has no hesitation to use coercion and force (even deadly force) against its perceived opponents and often uses the justice system as a tool to silence (and even incarcerate) those who get in its way, or even speak in opposition. Many of those who wield such force have sociopathic or psychopathic tendencies that are amplified by anonymity and legal immunities.

• Much of our Federal government has been privatized: Major Federal decisions and actions are now performed through private individuals (such as Jared Kushner or Elon Musk) or friendly private corporations such as Palantir or Oracle - many of whom skim a thick profit out of the deal.

• Our fifty States are divided - some overtly support or work hand in hand with the trump/maga forces within the Federal government.

• Although in some cases the harms that have been inflicted upon the people of the US (and the world) are clear and the victim can be precisely identified. However, in many cases, such as the dissemination of private citizen data into unregulated private hands, the harms are diffuse and spread across a large population.

Despite those seeming limitations, we must (and we will) find means to achieve, or at least approach, these goals.

This website is primarily focused on the establishment of an American Tribunal to investigate, judge, and levy judgement. However, this website contains an article that discusses what we can do now, without such a Tribunal.

The core article of this website is the article on Sources of Authority and Jurisdiction That article will look at whether the United States has authority and jurisdiction for a tribunal with great powers and great scope. I believe such powers exist, but that they are not obvious to those with traditional backgrounds in US history or law.

This website is intended to be a vehicle for the exploration of various means.

This inquiry is structured into several articles, each covering a specific topic area.

This website does not advocate violent means.

However, it is recognized that people, angry and frustrated, have at times throughout history tried to reach these goals through destruction and violence. It ought not to be surprising if out there in the real world that we see again incidents of that nature.
